Justified absence from work for people with endometriosis or adenomyosis

Law No. 32/2025 of March 27, which seeks to promote the rights of individuals affected by endometriosis or adenomyosis by strengthening their access to healthcare services and establishing a regime of justified absences from work and academic activities, entered into force on April 26. This legislation also amends the Labour Code.

The new law stipulates that workers experiencing severe and incapacitating pain due to endometriosis or adenomyosis are entitled to justified absences from work, without loss of any rights, including remuneration, for up to three consecutive days per month of employment.

The same provision applies to students with regard to absences from academic obligations.

The medical certificate, which must be submitted to the employer or the educational institution, does not require monthly renewal.

For employment purposes, Article 252-B has been added to the Labour Code. The medical certificate shall constitute sufficient justification for the absence, and the provisions of Article 254 of the Labour Code shall apply.

Furthermore, the law establishes a reimbursement scheme for medications prescribed within the National Health Service (SNS) by specialist physicians for the treatment and alleviation of symptoms associated with endometriosis and adenomyosis, including progestogens and other relevant treatments. The specific rules governing this scheme will be set forth in a separate ordinance.

Additionally, Law No. 32/2025 of March 27 aims to safeguard the right to fertility preservation, notably through the cryopreservation of oocytes, with the SNS responsible for the collection and storage procedures. This provision shall also apply to other medical conditions that may impair fertility and affect future parenting plans.

However, both the medication reimbursement scheme and the fertility preservation system will only become effective upon the approval of the State Budget.
