Directive on the Conditions of Entry and Residence of Third-Country Nationals for the Purpose of Highly Qualified Employment

Transposes Directive (EU) 2021/1883, concerning the conditions of entry and residence of third-country nationals for the purpose of highly qualified employment, amending Laws No. 23/2007, of 4 July, No. 53/2007, of 31 August, No. 63/2007, of 6 November, No. 27/2008, of 30 June, and No. 73/2021, of 12 November.

Entering into force on 29 October 2023, the regime transposed into the Portuguese legal system aims to establish a more effective and attractive framework across the European Union for highly qualified workers from third countries. It will serve as the primary instrument for attracting highly skilled professionals, featuring faster procedures, more flexible and inclusive admission criteria, and broader rights, including facilitated mobility within the EU.

The application for the "EU Blue Card" must be submitted either by the third-country national or their employer, to the consular posts, or, if the applicant is legally residing in Portugal, to the Regional Directorate or Delegation of AIMA, I.P. in their area of residence.

The "EU Blue Card" is initially valid for two years and may be renewed for successive periods of three years, unless the duration of the employment contract is shorter, in which case it is valid for that period plus three months.

A third-country national holding an "EU Blue Card" issued by another Member State that fully applies the Schengen acquis is authorised to carry out professional activities in Portuguese territory for up to 90 days within any 180-day period, with their entry and stay being permitted.
